By accessing and using the Castify app (hereinafter referred to as the "Service"), you hereby acknowledge and agree to be bound by these Terms and Conditions ("Terms"). This includes, without limitation, your express consent to our collection, processing, and utilization of data as delineated in our Privacy Policy. We collect data including, but not limited to, Apple ID information and your interactions with the Service, such as podcast topics and lengths. This data is utilized to monitor and restrict harmful content and potentially tailor personalized content. Data is collected upon your consent provided at account creation and is managed in accordance with our data retention and security protocols. 2. Description of Service

Castify employs state-of-the-art Language Model and Text-To-Speech technologies to generate unique podcasts based on user-specified topics and lengths. Please be advised that while we endeavor to filter out harmful content, our capacity to identify and reject sensitive topics is subject to ongoing refinement, particularly as we accumulate more user data. The autogenerated content may occasionally include imprecise or inaccurate information, and we are committed to enhancing this aspect through our continuous testing. Users should be cognizant of certain limitations during this phase, such as a cap of two podcasts per day. Your utilization of the Service contributes to our efforts to refine and augment its capabilities.

3. Use of Service and Acceptable Uses

As a user of the Castify app, you are obligated to use the Service solely for lawful purposes and in a manner that respects the rights of others. This includes, but is not limited to, refraining from any use that infringes upon intellectual property rights or violates any applicable laws or regulations. During our beta testing phase, we collect detailed data about your interactions with the Service. This encompasses, without limitation, the topics and lengths of the podcasts you generate, and your choice of voice options. The collection of this data is critical for us to identify and improve areas of the Service, such as enhancing content curation to prevent harmful topics and refining our algorithm for better accuracy. Your continued use of the Service indicates your consent to this data collection, which is integral to the improvement and personalization of your user experience. You may not access, use, or allow others to access or use the Service in any manner that would violate applicable laws, promote illegal activities, generate harmful content, or infringe upon the rights of others.

4. Intellectual Property

The content generated by the Castify app, utilizing advanced language processing technologies and updated web-sourced information, is the intellectual property of Castify LLC. While users can interact with and personalize this content, all rights, title, and interest, including intellectual property rights, regarding the underlying technology, methodologies, and the final output remain with Castify LLC. This includes any unique, proprietary processes integral to the app's functionality, for which a patent is pending. Reproduction, distribution, or creation of derivative works from any content produced by Castify without explicit written permission from Castify LLC is strictly prohibited and may result in legal action.

5. Disclaimer of Warranties

The Castify app is provided 'as is' and 'as available', without any representations or warranties, express or implied. Users should be aware that the content generated by our algorithms may occasionally include inaccuracies, fictitious events, or repetitive information, as our models are not infallible. There may be times when the Service is unavailable, or certain requested podcasts may not function as intended. While we take reasonable steps to provide a reliable service, we make no warranties regarding uninterrupted Service availability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AVAILABILITY, SECURITY, PRIVACY, COMPATIBILITY, NON-INFRINGEMENT, AND ANY WARRANTY IMPLIED BY COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE. Additionally, any liability for the manner in which users choose to use the generated content is expressly disclaimed.
